Sealed bids for the Wastewater Treatment Plant Improvements will be received on behalf of Netarts Oceanside Sanitary District (NOSD) by John L. Yarnall, PE of Westech Engineering, Inc. at 3841 Fairview Industrial Drive SE, Suite 100, Salem, Oregon 97302-1192, until the bid closing time of 2:00 p.m. local time on April 1, 2010. Bids will be opened (at the above address) immediately after the bid closing time, but written bid tabulations will not be released until after 4:00 p.m. (the submittal deadline for the “First-Tier Subcontractor Disclosure Form”). Bids shall be clearly marked “Bid for the Wastewater Treatment Plant Improvements,” showing the date and time of the public bid closing, as well as the Bidders name, and shall be delivered to the location specified above, by or before the above bid closing time.
By no later than 4:00 p.m. local time on April 1, 2010 (i.e. 2 working hours after the bid closing), each bidder shall deliver to John L. Yarnall, PE, of Westech Engineering, Inc., at the same address as the bids were delivered to, the “First Tier Subcontractor Disclosure Form” contained in the bidding documents. This form shall be submitted regardless of the bid total. Bidders who fail to submit the required disclosure form will be considered non-responsive, and their bid will not be considered for award. The disclosure form shall either be submitted in the same envelope as the bid, or shall be submitted in a separate sealed envelope clearly marked “Disclosure Form for the NOSD Wastewater Treatment Plant Improvements,” showing the date and time of the disclosure submittal deadline, as well as the Bidders name.
A mandatory pre-bid walk through for prospective bidders will be held at the Netarts Oceanside Rural Fire Protection District’s fire hall located on 5th Street Loop just south of Crab Avenue in Netarts at 10:00 AM local time on March 11, 2010. The formal prebid meeting will be from 10 AM until 11:30 AM. The District’s facilities (Existing WWTP, Oceanside Pump Station, WWTP Access Roadway, WWTP site and Waterline Alignment will be open for prospective bidders to view from Noon until 4 PM. This will be the best opportunity for prospective bidders to inspect the work sites; the work sites are not open to the public.
The work consists of eight (8) major components including the following:
• Construction of the Main Pump Station and Control Building; a ±1,800 gpm submersible pump station.
• HDD installed Influent Force Main; 20” HDPE pipeline approximately 3,500 feet long.
• HDD installed Final Effluent Line; 16” HDPE pipeline approximately 3,500 feet long.
• Offsite Water Improvements; a PRV station and a 10” HDPE pipeline approximately 4,000 feet long.
• Wastewater Treatment Plant Access Roadway; an improved roadway approximately 4,600 feet long.
• Electrical power and phone service installations to the new WWTP.
• Wastewater Treatment Plant; a new 0.40 mgd activated sludge WWTP with associated buildings.
• Oceanside Pump Station Reconstruction; conversion of a ±260 gpm wet well dry well pump station to a submersible pump station.
• Existing WWTP Site Demolition and Reclamation; abandonment, demolition and reclamation of the existing wastewater treatment plant site.

Copies of the Bid Documents and Full Size Drawings may be obtained for a non-refundable fee of $600 for each set of documents. Copies of the Bid Documents and Half Size Drawings may be obtained from Westech Engineering for a non-refundable fee of $400 for each set of documents. The above cost is for standard U.S. mail or UPS ground service. A physical address must be provided when ordering documents (for UPS shipping purposes). Half size drawings are provided for bidder’s convenience at their request, but do not replace full size drawings as official bidding documents.
This contract is expected to be funded in whole or in part using funds from the American Recovery and Reinvestment Act (ARRA). Section 1605 of the ARRA prohibits the use of these funds unless all iron, steel, and manufactured goods are produced in the United States. All iron and steel manufacturing processes must take place in the United States, except for metallurgical processes involving refinement of steel additives. There is no requirement for the origin of components and subcomponents of manufactured goods. Products listed in 48 CFR 25.104(a) have been determined to be unavailable in the United States and if required for the project may be purchased from foreign sources. No unauthorized use of foreign iron, steel, and /or manufactured goods will be allowed on this project.
The de minimus categorical exception applies to this project and concerns incidental components when they in total comprise no more than 5 percent of the total cost of the materials used in and incorporated into a project. This waiver was published in the September 25, 2009 federal register, Vol. 74, No. 185, pages 48901-48902 for USDA-Rural Utility Service. A copy is included in the end of the Information for Bidders.
Please note that the two places in the de minimus waiver refer to 5% of the project cost rather than material cost. Regardless of the language in these two places, the maximum amount of the de minimus items that may be considered waived under authority of this document is 5% of the materials cost. This may be understood because the waiver only applies to materials and the operative language of the waiver comes in the first paragraph of Section III.
The contractor must comply with the minimum rates for wages for laborers and mechanics as determined by the Secretary of Labor in accordance with the provisions of the Davis-Bacon and Related Acts.
The higher wages from the Department of Labor (DOL) wage determinations or the Oregon Bureau of Labor and Industry (BOLI) wage determinations are the minimums that may be paid by the contractor performing the work.
